Workmanship Warranty
Fullers Landscaping warrants its workmanship for a period of 12 months from the date of substantial completion. This warranty covers defects resulting directly from our installation only. Where a warranty claim is accepted, Fullers Landscaping will repair or replace the affected work at its sole discretion.

Retaining Walls
Retaining walls are constructed in accordance with accepted industry practices and the approved scope of work. Minor settlement, movement, and normal weathering are characteristic and not considered defects. Fullers Landscaping is not responsible for movement or failure caused by unsuitable or undisclosed soil conditions, groundwater, drainage issues outside the scope of work, excessive surcharge loads (including vehicles, structures, pools, hot tubs, or stockpiled materials), tree roots, excavation by others, acts of nature, or modifications made after installation. Unless specifically included in the contract, engineering services and permits required by local authorities are the responsibility of the property owner.

Hardscapes & Construction
Natural products and outdoor construction are subject to seasonal expansion, contraction, settling, and movement. Minor cracking, shrinkage, efflorescence, colour variation, joint separation, heaving, settling, or movement of concrete, pavers, retaining walls, fences, steps, edging, natural stone, wood products and other landscape materials caused by weather, ground conditions, moisture, frost, tree roots or normal wear are not considered defects and are not covered under warranty.

Plant Material
Trees, shrubs, sod and other living plant material are living products and cannot be guaranteed due to factors beyond our control, including weather, drought, irrigation, pests, disease, wildlife, soil conditions, frost, or homeowner maintenance. Unless otherwise stated in writing, plant material is not covered under warranty once installed.

Irrigation Systems
Irrigation systems are tested and confirmed operational upon completion. Fullers Landscaping is not responsible for damage or failures resulting from freezing, accidental damage, utility work, landscaping by others, root intrusion, ground movement, vehicles, animals, clogged emitters, or normal wear and tear. Seasonal winterization and spring start-up are the responsibility of the property owner unless contracted separately.

Drainage
Where drainage improvements are included in the scope of work, Fullers Landscaping warrants only the work installed. We cannot guarantee drainage performance where existing site conditions, neighbouring properties, extreme weather events, or changes made after completion affect drainage.

Service Calls
Service visits requested after project completion that are not covered under warranty are subject to a minimum call-out fee, plus labour, equipment and materials at current rates. Customers will be advised of applicable charges before work proceeds whenever practical.

Warranty Exclusions
This warranty does not cover damage resulting from abuse, misuse, neglect, lack of maintenance, alterations by others, excavation, utility work, acts of nature, flooding, fire, vandalism, vehicle damage, excessive loading, or circumstances beyond the reasonable control of Fullers Landscaping.

Limitation of Liability
Fullers Landscaping’s liability is limited to the repair or replacement of defective workmanship at our discretion. In no event shall Fullers Landscaping be liable for indirect, incidental, consequential or special damages, including loss of use, loss of enjoyment, loss of property value, or damages exceeding the original contract value.

Customer Acceptance
The customer agrees to inspect the completed work upon completion. Any workmanship concerns must be reported in writing within 14 days of substantial completion. Payment of the final invoice or continued use of the completed work constitutes acceptance of the completed project and these Terms & Conditions.

Existing Conditions: Fullers Landscaping is not responsible for concealed or pre-existing site conditions, including buried utilities, undocumented irrigation lines, unsuitable soils, tree roots, drainage issues, concrete thickness, property pins, or structures that were not visible or disclosed prior to construction. Any additional work required as a result of such conditions will be treated as a change order and billed accordingly.
